Indications of geographical origin

1. What is indication of geographical origin?

That is the right protecting two kinds of indications: appellations of origin and geographical indications.

Appellation of origin is the geographical name of the country, region or locality which serves to denote a product originating thereof, whose quality and special characteristics are exclusively or substantively conditioned by the geographical environment, including natural and human factors and whose production, processing and preparation are entirely taking place on a certain limited geographical area.

Geographical indication is an indication identifying certan goods as goods originating from the territory of a certain country, region or locality of that territory, where certain quality, reputation or other characteristics of the goods can essentially be attributed to its geographical origin.

2. Which products are marked by the indications of geographical origin?

Natural products (stone, marble, wool, glass, etc), agricultural products (tomato, paprika, peas, etc.), food products (cheese, cream cheese, ham, etc.), manufacturing products (carpets, special kind of leather shoes - opanak and other similar goods produced in manufactures), industrial products, as well as products of home made manufacture (products made by hand).

3. Why should we protect the indication of geographical origin?

Because the indication of geographical origin can be, and mostly is, a significant marketing tool which can guarantee to its owner an advantage in comparison to the competition in the process of economic competition. The product market by an indication of geographical origin (and in particular, the appellation of origin) is observed by the consumers as the product possessing special qualities, which another products of that kind do not possess.

4. How shall we protect indication of geographical origin?

Protection of the indication of the geographical origin unites two different procedures: procedure for the establishment of the indication of the geographical origin and procedure for the recognition of the status of the authorized user of the indication of the geographical origin.

If the indication of the geographical origin is being established for the first time before the Intellectual Property Office as a completely new right which has not been registered so far, the interested party shall initiate the procedure for the establishment of the indication of geographical origin.ž

If the indication of the geographical origin has already been established and recorded in the appropriate register, and if somebody wants to acquire the right to use that indication in the channels of commerce, he shall initiate the procedure for the recognition of the status of the authorized user of the indication of the geographical origin.

5. What are the most important facts with regard to the procedure for the establishment of the indication of the geographical origin?

a) Who can initiate the procedure?

Every domestic natural ar legal person that produces at a certan geographical area products that are marked by the name of that geographical area, as well as the associations of these persons; chambers of comerce, associations of consumers and government bodies interested in the protection of the appellation of origin or geographical indication in the framework of their activities;
Foreign natural or legal person, or foreign associations, can do so, if the appellation of origin or geographical indication is granted in the country of origin, or when it comes out of the international agreements.

b) How can one initiate procedure for the establishment of the indication of the geographical origin?

By filing an application for the establishment of the indication of geographical origin, which consists of:
- request for the establishment of the indication of geographical origin filed in two identical copies ( form G-1 is given in two formats: ( PDF_format ) and ( WORD_format ));
-data on the geographical area, filed in two identical copies ( for more details see Article 17 of the Law on Indications of Geographical Origin, which you can study by clicking on the desired format ( PDF_format ) and Article 5 of the Regulations on the Procedure for the Establishment of the Status of the Authorized User of the Geographical Indication of Origin which you can also see in the ( PDF_format );
- data on the specific characteristics of the product, which, if it concerns the application of the geographical indication, contains the manner of production of products, precise designation of specific characteristics or quality of product, including data on the acquired reputation, regulations who has the right to use the geographical indication and under what conditions, as well as regulations on the rights and obligations of the user of the geographical indication.

Of the application is filed on the establishment of the application of origin, data on specific characteristic of the product are filed in the shape of the elaborate on the manner of production of the product and the special characteristic and quality of the product ( for more details see Article 18 of the Law on Indications of Geographical Origin and Article 6 of the Regulations on the Procedure for the Establishment of the Indication of Geographical Origin and Recognition of the Characteristics of the Recognized User of the Indication of Geographical Origin).

Request for the establishment of the appellation of origin and geographical indication is the mentioned form G-1, only on the suitable part of that form, by entering mark X one should designate whether the protection is required for the appellation of origin or for geographical indication.

c) Fee for initiating the procedure for the establishment of the indication of geographical origin

Six thousand and three hundred (6.300,00) dinars. Proof of the paymant of fees, in the form of the third copy of swift is bound to be forwarded to the IPO.

6. What are the most important facts with regard to the procedure for the recognition of the characteristic of the authorized user?

a) Who can file an application for the recognition of the characteristic of the authorized user of the indication of geographical origin?


Every natural or legal person that produces on a certain geographical area products marked by the name of that geographical area, as well as associations of those natural or legal persons.

b) How can one initiate procedure for the recognition of the characteristics of the authorized user of the indication of geographical origin?

By filing application for the recognition of the characteristics of the authorized user, consisting of:
- request for the grant of the characteristics of the authorized user ( form O-1 is given in two formats: ( PDF_format ) ( WORD_format )) and which is filed in two identical copies;
- proof on the performance of certain activities, is filed in two identical copies ( for more details see Article 10 of the Regulation on the Procedure for the Establishment of the Indication of Geographical Origin and Recognition of the Status of the Authorized user of the indication of Geographical Origin);
- proof on the performed control of products which is filed in two identical copies ( for more details see Article 11 of the Regulation on the Procedure for the Establishment of the Indication of Geographical Origin and Recognition of the Status of the Authorized User of the Indication of Geographical Origin).

c) Fee for the initiation of the procedure for the recognition of the characteristics of the authorized user of the indication of geographical origin?

Twelve thousand six hundred and twenty (12.620,00) dinars.
